Agreement.

1.1 Eligibility Requirements

Without limiting the SoVia Terms of Service, you must be at least 18 years of age (or the legal age of majority in your jurisdiction) to access or use SoVia AI. If applicable law prohibits you from obtaining AI services, you are strictly forbidden from accessing SoVia AI.

1.2 Overview of Capabilities

SoVia provides a range of personal AI functionalities, including:

• Personal AI Companion: Interactive dialogue streams offering conversational support, tone matching, and topic suggestions.
• AI Recommendation Lines: Real-time generated caption prompts and recommendation lines tailored to your post feeds.
• Visual Image Analysis: Aesthetic, contextual, and feature analysis of uploaded post photos.
• Vibe-Matching Algorithms: Personalized feed inference matching user lifestyle tags with relevant creator profiles and posts.
• Inter-User AI Interactions: Engaging in text dialogue, visual interactions, and ice-breaker conversations with AI companions or digital personas published by other users or creators.

2.1 Content Rights in Inputs

You may provide inputs for AI processing, including text prompts, dialogue commands, uploaded images, lifestyle tags, and interaction feedback (collectively, "Prompts"). Except as expressly provided in this Agreement, you retain all right, title, and interest in and to your Prompts.

2.2 Warning Against Submitting Sensitive Personal Information

Once information is shared with SoVia AI, the system may retain and process it within dialogue context streams to generate personalized responses. You are strictly instructed NOT to share sensitive personal information in your Prompts—such as passwords, account identification details, financial or credit card information, government ID numbers, or unapproved medical details—that you do not wish AI systems to process or retain.

2.3 Automated and Human Review of AI Chats

To maintain safety, detect policy violations, and improve service quality, you acknowledge and agree that Chattrix Limited, its automated moderation systems, trained safety staff, or authorized third-party service providers may review your interactions and dialogue history with SoVia AI via automated or manual (human) review.

3.1 Disclaimer of Accuracy & No Professional Advice

SoVia AI generates responses probabilistically. To the maximum extent permitted by law, Chattrix Limited makes no representations or warranties regarding the accuracy, reliability, completeness, or timeliness of AI outputs. AI outputs MUST NOT be relied upon as medical, legal, financial, psychological, or other professional advice, or used for critical decision-making.

3.2 User Assumption of Risk for Offensive or Objectionable Outputs

Because AI responses are generated dynamically based on context and prompts, it is impossible to predict all outputs in advance. SoVia AI may occasionally generate outputs that you find inaccurate, offensive, objectionable, or disturbing. AI outputs reflect statistical processing and do not represent the views or opinions of Chattrix Limited. By using SoVia AI, you explicitly acknowledge and accept the risk of encountering unexpected AI outputs, and you agree that you are solely responsible for any actions you take based on AI-generated content.

You agree not to access, prompt, or use SoVia AI to:

4.1 Harmful, Illegal & Exploitative Activities

• Violate any applicable laws, or generate content promoting hate speech, violence, harassment, or illegal acts.
• Engage in manipulative, deceptive, or subconscious techniques designed to impair individuals' decision-making abilities or distort their behavior.
• Exploit individuals' age, disability, or specific social or economic status to alter their behavior to their detriment.
• Induce or promote risks of death, physical harm, self-harm, weapons manufacturing, or illegal drug use.

4.2 Sexual Content & Child Safety — Zero Tolerance

• Generate, promote, or facilitate adult content, pornography, or material intended to arouse sexual excitement.
• Upload nude or sensitive imagery of individuals under 18 years of age.
• Prompt AI to generate, describe, or roleplay minor characters or sexualized scenarios involving minors.

4.3 Model Jailbreaking & System Abuse

• Execute prompt injection attacks, bypass safety filters, or reverse-engineer AI pipelines.
• Scrape AI outputs, extract underlying model weights, or generate automated spam.
• Attempt to jailbreak, manipulate, or harass another user's or creator's AI companion, or extract their private prompt configurations and persona settings.

5.1 Facial Feature and Image Analysis

When you upload images to SoVia AI, our systems analyze visual aesthetics, scene composition, and visual features to generate caption recommendations, summarize visual content, and power AI multi-modal responses.

5.2 Biometric Privacy Laws Compliance (BIPA / CIPA)

You explicitly represent and warrant that you will NOT upload any images to SoVia AI containing residents of Illinois (under the Illinois Biometric Information Privacy Act - BIPA) or Texas (under the Texas Capture or Use of Biometric Identifier Act - CIPA) unless you are their legally authorized representative and have obtained explicit, verifiable consent on their behalf prior to uploading.

• User Inputs: You retain ownership of your original Prompts. You grant Chattrix Limited a worldwide, non-exclusive, royalty-free license to host, process, reproduce, and display your inputs solely to provide and optimize the Service.
• Platform Ownership of AI: Chattrix Limited and its licensors retain all right, title, and interest (including all intellectual property rights) in and to SoVia AI, its underlying models, algorithms, and interface software. Nothing in this Agreement grants you any ownership rights in SoVia AI.
• AI Outputs: You receive a personal, worldwide, non-exclusive, revocable license to use AI-generated outputs for non-commercial personal use within the app, subject to compliance with this Agreement.

8.1 Express Disclaimer of Warranties

SoVia AI and all generated outputs are provided on an “AS IS” and “AS AVAILABLE” basis. To the maximum extent permitted by applicable law, Chattrix Limited disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, security, non-infringement, and availability.

8.2 Limitation of Liability

To the maximum extent permitted by applicable law, Chattrix Limited shall not be liable for any indirect, incidental, special, punitive, exemplary, or consequential damages, or any loss of profits, data, or goodwill arising out of or related to your use of or reliance on SoVia AI.

9.1 Suspension and Termination

If Chattrix Limited determines that you have violated this Agreement or any safety policies, we reserve the right to immediately suspend or permanently revoke your access to SoVia AI features, or delete your account without prior notice.

9.2 Dispute Resolution & Severability

• Disputes: Any legal claims or disputes arising out of or related to this Agreement shall be governed by the dispute resolution procedures set forth in the SoVia Terms of Service.
• Severability: If any provision of this Agreement is held to be invalid or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.
• No Waiver: Our failure to enforce any right or provision of this Agreement shall not constitute a waiver of such right.

We may update this Agreement from time to time to reflect improvements to our AI models, safety guardrails, or legal requirements. Material updates will be notified in-app or via email. Continued use of SoVia AI after updates take effect constitutes your acceptance of the revised Agreement.
